Expert Witness Services
Not all litigation involving land surveyors will involve a property dispute. Contractual matters, standard of care and professional negligence, and scope of services are all matters that can become contentious. Mark Chastain has been admitted at trial or hearing as an expert witness 17 times since 1997 and has given several depositions. We have been involved in the role of surveyor and consultant in dozens of other cases that were settled or have yet to be tried.
Notable recent cases include:
- Bruce vs. Jones & Long. Boundary dispute in Fannin County resulting in a Superior Court ruling which was later upheld by the Georgia Supreme Court. Chastain & Associates, P.C. identified and surveyed the disputed area and Mark Chastain testified as an expert witness at trial.
- Pearson vs. Pruitt. Civil case in Gwinnett County, Georgia. Mark Chastain provided consulting and expert testimony at trial regarding Land Surveying Scope of Service and Standard of Care.
- O'Donnell vs. Cheek. Dispute over access rights, a subdivision, and an old county road before the Chancery Court of Polk County, Tennessee. Chastain & Associates, P.C. prepared various surveys of the access elements. Mark Chastain provided consulting and due diligence with the Tennessee Department of Transportation to reach a settlement agreement.
- Commonwealth of Pennsylvania vs. Davey Resource Group. Mark Chastain provided consulting and expert testimony at hearing regarding Land Surveying practice, precision standards, and scope of service matters.
Mark Chastain has also served twice as a Subject Matter Expert (SME) for the Georgia Secretary of State's Examinations Unit for writing and reviewing questions for the Georgia Land Surveyor licensing exam.
His service on the Georgia Board of Registration for Professional Engineers and Land Surveyors has also helped to broaden his understanding of standard of care, liabilities, and due diligence involved in the practice of Land Surveying.
